1. Acceptance of Terms
By accessing our website, booking a lesson, or participating in driving instruction with Kathmandu Driving School (“we”, “us”, “our”), you agree to be bound by these Terms and Conditions.
If you do not agree to these Terms and Conditions, you must not use our services.
If the student is under 18 years of age, consent must be provided by a parent or legal guardian before any lessons are booked or undertaken.
2. Lesson Bookings
- All lessons must be booked in advance by phone, messaging app, or online (where available).
- Lesson duration includes pick-up and drop-off unless otherwise agreed.
- All bookings are subject to availability.
- We reserve the right to refuse or cancel bookings where necessary, including where these Terms and Conditions are breached.
3. Payments
- Payment is required before or at the commencement of the lesson unless otherwise agreed.
- Prices are listed in Australian Dollars (AUD).
- Prices may change without notice; however, confirmed bookings will honour the agreed price.
- Lesson packages must be used within the stated validity period at the time of purchase.
4. Cancellations and Rescheduling
- A minimum of 24 hours’ notice is required to cancel or reschedule a lesson.
- Lessons cancelled with less than 24 hours’ notice will be charged in full.
- Failure to attend a scheduled lesson (no-show) will result in forfeiture of the lesson fee.
- Exceptions may be considered in genuine emergencies at the instructor’s discretion.
- We reserve the right to reschedule lessons due to instructor illness, mechanical issues, severe weather, or safety concerns.
5. Learner Requirements
Students must:
- Hold and carry a valid WA Learner or Provisional Licence during each lesson.
- Be medically fit to drive.
- Ensure they meet all eyesight, medical, and licensing requirements imposed by the Department of Transport Western Australia.
- Not attend lessons under the influence of alcohol, drugs, or medication that may impair driving ability.
- Wear appropriate closed footwear.
If these requirements are not met, the lesson may be cancelled or terminated and charged in full.
6. Safety and Instructor Authority
Driving involves inherent risks. Students acknowledge and accept these risks when taking part in lessons. The instructor may end a lesson immediately if:
- The learner behaves in an unsafe, unlawful, or aggressive way;
- The learner refuses to follow reasonable instructions;
- Road, weather, traffic, or vehicle conditions are deemed unsafe.
In these situations, no refund will be issued.
7. Vehicles and Dual Controls
Lessons are conducted in dual-control vehicles for safety. Students must take reasonable care when operating the vehicle. Deliberate or reckless damage caused by a learner may result in liability for repair costs.
8. Logbook Lessons (WA)
For learners participating in the Western Australian Learner Log Book program:
- Only lessons that satisfy the applicable Department of Transport Western Australia requirements may be signed off by the instructor.
- Learners are required to complete a minimum of 50 hours of supervised driving, including at least 5 hours of night driving, in accordance with Department of Transport WA requirements.
- A driving instructor may only sign a limited number of hours as permitted under Department of Transport Western Australia regulations.
- Eligible lessons may be recorded in the learner’s logbook in accordance with Department of Transport Western Australia requirements applicable at the time of the lesson.
- Learners are responsible for presenting their logbook (or approved electronic record, where applicable) and ensuring all entries are accurate and complete.
- It is the learner’s responsibility to maintain their logbook and comply with all licensing and logbook requirements imposed by the Department of Transport Western Australia.
- Kathmandu Driving School is not responsible for lost, damaged, incomplete, inaccurate, rejected, or incorrectly recorded logbook entries.
- Completion of driving lessons and/or logbook entries does not guarantee acceptance by the Department of Transport Western Australia, eligibility for a Practical Driving Assessment, or the issue of a driver’s licence.
9. Driving Test Bookings
- Use of the instructor’s vehicle for a driving test must be booked in advance.
- Test packages are non-refundable once confirmed.
- Additional time beyond the allocated package may incur extra charges.
- We do not guarantee that a student will pass any driving assessment or test.
10. Lesson Packages and Promotions
- Packages and special offers must be used within the stated validity period.
- Packages are non-transferable.
- Packages are non-refundable once commenced, except where required by Australian Consumer Law.
11. Limitation of Liability
To the maximum extent permitted by law, Kathmandu Driving School Perth Pty Ltd is not liable for:
- Indirect, incidental, or consequential loss;
- Missed driving tests or associated fees;
- Delays caused by traffic, weather, or mechanical issues beyond our reasonable control;
- Loss of income or opportunity.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law that cannot lawfully be excluded.
12. Privacy
We collect and handle personal information in accordance with our Privacy Policy, available on our website.
13. Website Use
All website content is provided for general information purposes only. We make reasonable efforts to ensure accuracy but do not guarantee that content is error-free or up to date. All website materials are protected by intellectual property laws and may not be reproduced without permission.
14. Camera and Voice Recording Policy
14.1 Use of Cameras and Audio Recording
Kathmandu Driving School vehicles may be fitted with cameras and/or audio recording devices for the purpose of:
- Learner and instructor safety
- Training and assessment review
- Incident protection, including accidents, complaints, or disputes
- Insurance and legal requirements
- Quality assurance and service improvement
Recording may include video footage, audio (voice), and driving data captured during lessons, tests, or supervised drives.
14.2 Consent
By booking lessons, participating in driving sessions, or entering a Kathmandu Driving School vehicle, the learner and any accompanying person:
- Acknowledge that video and/or audio recording may occur during lessons in accordance with these Terms and Conditions.
- Provide consent to such recording during lessons.
If a learner does not consent, they must notify Kathmandu Driving School before the lesson. We reserve the right to refuse or cancel the booking where suitable alternative arrangements are not available.
14.3 Privacy and Use of Recordings
All recordings are:
- Handled in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs)
- Used only for legitimate business purposes
- Stored securely and not shared with third parties, except where required by:
- Law enforcement,
- Insurance providers,
- Legal proceedings,
- Regulatory authorities.
14.4 Access to Recordings
Access to recordings is:
- Restricted to authorised Kathmandu Driving School personnel
- Reviewed only when necessary, such as for safety reviews or investigations
Learners do not have automatic access to recordings unless required by law.
14.5 Retention and Deletion
Recordings are retained only for as long as reasonably necessary to fulfil their purpose and are securely deleted in accordance with regulatory and business requirements.
14.6 Refusal or Tampering
Learners must not:
- Interfere with, damage, or disable recording equipment
- Obstruct camera or audio devices
Doing so may result in lesson termination without refund and possible suspension of services.
15. Governing Law
These Terms and Conditions are governed by the laws of Western Australia, Australia. Any disputes arising from the use of our services or websites shall be subject to the exclusive jurisdiction of the courts of Western Australia.
16. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. The most recent version published on our website will apply to all new bookings.
